1. Acceptance and scope

These Terms of Use ("Terms") are an agreement between you and Rhythm Church in Lexington, Kentucky ("Rhythm Church," "we," "us," or "our"). They apply to this website and any Rhythm Church page, form, resource, or online service that links to them. Our Privacy Policy is incorporated into these Terms.

You must be legally able to agree to these Terms. If you are under 18, use the website with the involvement and permission of a parent or legal guardian.

2. Changes and website availability

We may update these Terms by posting a revised version and changing the "Last updated" date. Changes apply prospectively when posted unless applicable law requires otherwise. Your continued use after an update means you accept the revised Terms.

We may change, suspend, remove, or restrict any website feature, content, or service at any time. We do not guarantee that the website or any feature will always be available, uninterrupted, accurate, or error-free.

3. Permitted and prohibited use

You may use this website for lawful, personal, and noncommercial purposes consistent with Rhythm Church's mission. You agree not to:

• Use the website in violation of any law or the rights of another person.
• Exploit, endanger, impersonate, harass, defame, or mislead another person, including a minor.
• Submit information that is false, fraudulent, threatening, obscene, unlawful, or that you do not have the right to provide.
• Introduce malware, attempt unauthorized access, interfere with security, overload the website, or disrupt another person's use.
• Scrape, harvest, copy, frame, reproduce, or commercially exploit the website or its content except as expressly permitted by law or by our written permission.
• Suggest that Rhythm Church endorses you, your organization, or your content without written permission.

We may restrict access or take other reasonable action when we believe use violates these Terms, threatens security, or harms Rhythm Church or another person.

4. Forms, requests, and submissions

You are responsible for the accuracy of information you submit. If you provide information about a child or another person, you represent that you are authorized to provide it. You grant Rhythm Church and its service providers permission to process your submission for the purpose for which it was provided and as described in our Privacy Policy.

Submitting a form does not guarantee a response, reservation, registration, ministry service, or particular outcome. Online forms are not monitored continuously and must not be used for emergencies or urgent safety concerns.

5. Email and text messages

If you ask us to contact you, we may respond using the information you provide. Where you separately consent to recurring text messages, message frequency may vary and message and data rates may apply. Consent to receive text messages is not required to attend, give, register, or participate.

You may reply STOP to an eligible automated text message to opt out and HELP for help. Delivery depends on your mobile carrier and is not guaranteed. You are responsible for keeping your contact information current and for any charges imposed by your provider.

6. Online giving

Online donations are processed through Church Center, Planning Center, or another third-party provider. Their terms and privacy practices also apply. Before submitting a donation, review the amount, frequency, payment method, and any designation carefully.

Charitable gifts are generally nonrefundable. If you believe a donation was made in error, contact us promptly. Rhythm Church retains control and discretion over donated funds in a manner consistent with its charitable mission and applicable law. We will seek to honor a stated designation, but may redirect funds if a project is completed, overfunded, no longer feasible, or if another use is reasonably necessary to carry out the intended charitable purpose.

Website content and donation acknowledgments are not tax, legal, or financial advice. Consult a qualified professional about your circumstances and keep any official receipt provided for your records.

7. Third-party services and links

The website may link to or embed services that Rhythm Church does not operate, including Church Center or Planning Center, YouTube, Google Maps, and social-media platforms. A link does not mean we endorse every statement, product, policy, or practice of the third party. Your use of those services is governed by the third party's own terms and policies, and you use them at your own risk.

8. Intellectual property

The website and its original text, design, photographs, video, audio, sermons, logos, graphics, code, and other content are owned by Rhythm Church, licensed to us, or used with permission and are protected by intellectual-property laws. "Rhythm Church" and related names, logos, and branding may not be used in a way that suggests sponsorship or endorsement without written permission.

You may view and share links to public pages for personal, noncommercial purposes. Any other reproduction, adaptation, distribution, public display, sale, or commercial use requires permission from the applicable rights holder.

9. Ministry, prayer, and pastoral-care information

Sermons, articles, prayer resources, and other ministry content are provided for general spiritual and educational purposes. They are not a substitute for medical, mental-health, legal, financial, or other professional advice, diagnosis, or treatment.

Submitting a prayer request or care form does not create a confidential counseling, professional, fiduciary, or clergy-penitent relationship and does not guarantee a response. 10. Disclaimers

To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without warranties of any kind, express or implied. Rhythm Church disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that content is complete, current, free of errors, secure, or suitable for every person or circumstance.

11. Limitation of liability

To the fullest extent permitted by law, Rhythm Church and its pastors, staff, volunteers, officers, directors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, opportunity, goodwill, or use, arising from or related to the website, its content, your submissions, or third-party services.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

12. Responsibility for misuse

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Rhythm Church and its pastors, staff, volunteers, officers, directors, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the website, your violation of these Terms, or your violation of another person's rights.

13. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any legal proceeding arising from these Terms or the website that is not otherwise subject to mandatory law must be brought in a state or federal court located in or serving Fayette County, Kentucky, and you consent to that jurisdiction and venue.

14. General terms

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written consent. These Terms and the Privacy Policy are the entire agreement between you and Rhythm Church concerning use of this website, except for any separate terms that apply to a specific service.
